Purpose of Processing and Legal Basis for Processing

If you provide us with your data, we will process it for the purpose of:

  • providing services by electronic means – the basis for processing is the necessity of processing to perform this service (Article 6(1)(b) GDPR),
  • ensuring greater security of services, including detecting fraud and abuse – the basis for processing is our legitimate interest (Article 6(1)(f) GDPR).
  • conducting measurements (e.g., regarding the performance of our website, the activity of visitors), which allow us to improve services – the basis for processing is our legitimate interest (Article 6(1)(f) GDPR).

Data Recipients

In order to enable the use of our services, we use the support of several external companies. Therefore, the personal data we process may be transferred to:

  • service providers: IT, administrative and financial services, entities providing accounting services: Jantex Finanse Sp. z o.o. with its registered office in Zielniki, entities providing legal assistance, security agencies, debt collection companies, entities providing telecommunications services, entities providing banking services, domestic payment institutions, entities providing monitoring services, entities conducting postal or courier activities, providers of marketing services including newsletter services, providers of booking portal services.
  • state authorities or other entities authorized under applicable law.

On our website, we also use Google Analytics to monitor and analyze traffic. This means that we transfer some of the users' personal data to Google Ireland Ltd. and Google LLC – a company headquartered in Mountain View, California. Therefore, we may store Google Analytics cookies on your device in accordance with the provisions regarding cookies referred to below. The legal basis for transferring data to the USA is Standard Contractual Clauses – a special version of an agreement approved by the European Commission.

Additionally, in connection with visiting our fan pages on social media platforms, we may share your personal data with:

  • Facebook Ireland Limited – this entity processes personal data related to visiting our fan page on Facebook, Instagram, or contacting us via Messenger. It is a subsidiary of Facebook Inc. headquartered in California, USA. The transfer of personal data to the USA may take place on the basis of Standard Contractual Clauses, a special agreement whose model has been approved by the European Commission,
  • Google Ireland Limited – this entity processes personal data related to visiting our fan page on YouTube. It is a subsidiary of Google LLC headquartered in California, USA. The transfer of personal data to the USA may take place on the basis of Standard Contractual Clauses, a special agreement whose model has been approved by the European Commission,
  • LinkedIn Corp. headquartered in San Francisco, California, USA – this entity processes personal data related to visiting our fan page on LinkedIn. The transfer of personal data to the USA may take place on the basis of Standard Contractual Clauses, a special agreement whose model has been approved by the European Commission.

Data Retention Period

If you provide us with your personal data, it will be stored only for the period necessary for the purposes of processing.

  • if you are a visitor to our website, we process your personal data for as long as you use the site and for up to fourteen months after your last visit,
  • if you are our client, contractor, or representative of an organization with which we cooperate (have a contract), we process your personal data for as long as the business cooperation with our client or contractor lasts and for up to seven years after the end of such cooperation,
  • if you are a person who has written to us using the contact form on our website, contacted us by phone or email – we process your personal data for as long as the contact between you and us continues. If the data provided may constitute evidence in proceedings conducted under legal regulations, the retention period is extended to 7 years from the date of data disclosure,
  • if you are a person who has visited our profile on social media, liked or commented on a post on social media, or written to us using the Messenger application, we process your data for as long as our profile exists on such a social media platform, but no longer than the time during which you are a user of such a site,
  • if you are a person who has subscribed to our mailing list – we process your personal data until you unsubscribe from our mailing list or after the completion of marketing activities based on the mailing list,
  • if you participate in a recruitment process, in the case of processing within an ongoing recruitment – we process your personal data until the end of the recruitment process, and after its completion – for an additional period of 3 years. We will cease processing data earlier if you withdraw the consent that was the basis for their processing.

Rights Related to Data Processing

Requirements for Providing Data

You have the right to:

  1. access the provided personal data and to rectify, delete, or restrict their processing,
  2. data portability, i.e., to receive from us the personal data you have provided in a structured, commonly used, machine-readable format, if they are processed on the basis of a contract or consent and the processing is carried out in an automated manner. You have the right to transmit this data to another data controller,
  3. lodge a complaint with the supervisory authority responsible for the protection of personal data.

Additionally, you also have the right to object at any time to the processing of data if the basis for processing is the legitimate interest of the Controller, including profiling.

If the basis for processing personal data is your consent, you have the right to withdraw it at any time. However, before its withdrawal, we had the right to process your data. Consent may be withdrawn in any form, including: in writing, by email to: [email protected].

Providing personal data is voluntary, however:

  • if you are a person who has written to us using the contact form – providing data (name, surname, email address) is mandatory – without providing this data, it is not possible to respond to the inquiry and provide our answer.
  • if you participate in a recruitment process – providing data: name, surname, date of birth, contact details, is mandatory – without providing this data, employment with us is not possible. Providing data such as: education, professional qualifications, and employment history is mandatory only when performing work of a specific type or in a specific position, while providing other data is mandatory only when it is necessary to exercise a right or fulfill an obligation arising from legal regulations.

Providing personal data processed on the basis of consent or in the content of a message sent to us (e.g., via the contact form) is always voluntary.

Automated Decision-Making

The processing of data provided for the purpose of providing services by electronic means does not constitute profiling within the meaning of Article 22(1) GDPR, consisting of automated decision-making (i.e., without human intervention).

Liability

We make every effort to ensure your continuous access to the site; however, due to technical limitations, we cannot guarantee that its use will be uninterrupted. Therefore, we reserve the right to introduce restrictions on the use of the site caused by technical service, maintenance work, or work on improving its functionality. Any restrictions on the use of the site that may affect the deterioration of the quality of services provided will take place after prior notification to you at least 24 hours in advance. Each interruption in the use of the site will not exceed 5 hours.

To reduce the risk of these threats, remember to always have current antivirus software running on your device and exercise caution when installing any software, opening electronic correspondence and attachments, etc., and keep your assigned logins or passwords strictly confidential.
